Terms of Service

Last updated: September 28, 2026

These Terms of Service (the “Terms”) are an agreement between you and Caelin Lloyd (“we”, “us” or “our”), the developer of Music Zoom. They cover the Music Zoom app for iPad (the “App”) and the website at musiczoom.app (the “Website”). By downloading or using the App, or by using the Website, you agree to these Terms. If you don’t agree, please don’t use them. Our Privacy Policy forms part of these Terms. If you’re under the age of majority where you live, please review these Terms with a parent or guardian.

1. Your licence to use the App

We give you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. This includes using it in practice, teaching, rehearsal and performance. If your organization provided the App, you may use it as your organization permits. The App is licensed to you, not sold. You may not:

  • copy, modify or distribute the App, except as the law allows;
  • decompile, reverse engineer or try to extract the App’s source code, except where the law expressly allows it;
  • rent, lease, lend, sell, sublicense or otherwise transfer the App;
  • remove or change any copyright or other notices in the App; or
  • use the App in any unlawful way.

2. Free version and subscriptions

Free version. You can use the App for free with a limited number of songs. A subscription unlocks full access, including unlimited songs. The App describes what’s included in each, and this may change over time.

Plans and billing.

  • Music Zoom offers auto-renewing subscriptions of different lengths. The App shows the available plans and prices before you buy. These may vary by country.
  • Payment is charged to your Apple Account when you confirm your purchase.
  • A subscription renews automatically unless you cancel at least 24 hours before the current period ends. Apple charges the renewal within the 24 hours before the period ends.
  • You can manage or cancel at any time in your Apple Account settings (Settings > your name > Subscriptions), or from the About screen in the App. Cancelling stops future renewals, and you keep access until the end of the period you’ve paid for.
  • Where available, some plans let you pay for a 12-month subscription in monthly instalments. If you choose one, you’re committing to the full 12 months. Cancelling stops it from renewing for another 12 months, but it doesn’t cancel the payments left in your current commitment. The App Store shows the details before you confirm.
  • If we offer a free trial or introductory price, the App Store shows its terms before you confirm. Unless you cancel at least 24 hours before a free trial ends, your subscription begins and you’re charged when it ends.

Price changes. We may change subscription prices. Apple will tell you in advance and, where required, ask you to agree before an increase takes effect.

Refunds. Apple processes all purchases, so we can’t issue refunds directly. Apple handles refund requests at reportaproblem.apple.com. This doesn’t limit your rights under consumer protection law.

If your subscription ends. You can still open the songs already in your library. Features that need a subscription, such as adding songs beyond the free limit, stay unavailable until you subscribe again. We won’t delete Your Content because a subscription ends.

Schools and organizations. If your school or organization gives you the App or a subscription, for example through Apple School Manager, your organization controls that access and can assign or remove it.

3. Your content

“Your Content” means the sheet music, images, markings, annotations and other material you add to or create in the App.

You own Your Content. We don’t claim any ownership of it, and because the App keeps it on your device and in your own iCloud storage, we never receive it.

You’re responsible for having the rights to it. Sheet music is often protected by copyright. Only import, photograph, copy or share music that you own, that’s in the public domain, or that you otherwise have the right to use this way. The rules on copying music for personal or accessibility purposes differ between countries, so check the ones that apply to you.

Keep backups. You’re responsible for backing up Your Content. We recommend keeping iCloud sync on, and keeping your original printed or digital sheet music. We can’t recover data that’s been lost, deleted or never synced.

4. Performance and accessibility

Music Zoom is designed to make sheet music easier to read, including for musicians with low vision. However:

  • the App is a reading aid, not a medical device, and isn’t intended to diagnose, treat or correct any vision condition;
  • like any technology, the App, your device, iCloud or accessories such as footswitches can fail, run out of power or behave unexpectedly. For important performances, we recommend having a backup; and
  • we don’t make or support footswitches or other third-party accessories and aren’t responsible for how they work.

5. Beta versions and feedback

We may offer pre-release versions of the App through TestFlight. Betas may have bugs, may be incomplete and could lose data, so please back up anything important. They’re provided “as is”, may stop working at any time, and are also subject to Apple’s TestFlight terms. If you send us feedback or suggestions, you allow us to use them without any obligation to you.

6. The Website

You may use the Website for lawful purposes. Don’t try to disrupt it, gain unauthorized access to it, scrape it at scale, or use it to send spam or harmful content. You’re responsible for any comment or message you submit, and we may remove comments at our discretion.

7. Our intellectual property

Caelin Lloyd or our licensors own the App, the Website and their content, including the Music Zoom name, logo, design and software. These Terms don’t give you any right to use our name, logos or trademarks. The App includes open-source components, such as ZIPFoundation (MIT License), and their own licences apply to them.

8. Disclaimer of warranties

To the fullest extent the law allows, the App and the Website are provided “as is” and “as available”, without warranties of any kind, whether express or implied. This includes implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that they’ll be uninterrupted, error-free or secure, or that data won’t be lost. Some places don’t allow certain warranties to be excluded, so parts of this section may not apply to you.

9. Limitation of liability

To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special, consequential or punitive damages. Nor are we liable for any loss of data, profits, revenue, goodwill or performance opportunities that arises from or relates to your use of the App or Website, or your inability to use them. Our total liability for all claims is limited to the greater of (a) what you paid for Music Zoom subscriptions in the 12 months before the claim arose, or (b) CAD $50. Nothing in these Terms limits liability that the law doesn’t allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence.

10. Your consumer rights

Nothing in these Terms limits any rights you have under consumer protection laws that can’t be waived by contract.

11. Ending these Terms

You can stop using Music Zoom at any time by deleting the App. Deleting the App doesn’t cancel an App Store subscription, so cancel it in your Apple Account settings. Your licence ends automatically if you seriously breach these Terms. Sections that by their nature should continue after these Terms end still apply, including Your Content, intellectual property, disclaimers, limitation of liability and governing law.

12. Changes to the App and these Terms

We may update, change or discontinue features of the App or Website. We may also update these Terms. When we do, we’ll change the date at the top and post the new Terms in the App and on the Website, and we’ll give reasonable notice of significant changes. If you keep using Music Zoom after the changes take effect, you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada that apply there. The courts of Nova Scotia have jurisdiction over any dispute. However, if you’re a consumer, your local law may also let you bring a claim in the courts where you live. The UN Convention on Contracts for the International Sale of Goods doesn’t apply.

14. Terms required by Apple

These terms apply when you get the App from the App Store:

  • Acknowledgement. These Terms are between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
  • Scope of licence. Your licence is limited to using the App on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with you through Family Sharing or volume purchasing may also access and use the App.
  • Maintenance and support. We’re solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to provide maintenance or support for the App.
  • Warranty. We’re solely responsible for any product warranties, whether express or implied by law, to the extent they’re not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the fullest extent the law allows, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
  • Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it. This includes (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims under consumer protection, privacy or similar legislation.
  • Intellectual property rights. If a third party claims that the App, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  • Legal compliance. You represent and warrant that (i) you’re not located in a country that’s subject to a U.S. Government embargo or that the U.S. Government has designated a “terrorist supporting” country; and (ii) you’re not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Send any questions, complaints or claims about the App to us using the contact details below.
  • Third-party terms. When using the App, you must comply with any applicable third-party terms, such as your wireless data service agreement.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary, and will be deemed to have accepted that right.

15. General

These Terms and our Privacy Policy are the entire agreement between you and us about Music Zoom. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a right, that doesn’t mean we’ve waived it. You may not transfer these Terms to anyone else. We may transfer them as part of a sale or transfer of Music Zoom.
